Local Government Acquisition Tools Using Case Studies

Using the acronym, CAPS, Art Harrington discusses important issues to brownfield redevelopment.

    C- Challenges to brownfield redevelopment such as the
    public trust doctrine. Private citizens have to a trial if they feel that the public trust doctrine has been violated.
    A – Assess on brownfield sites can been obtained by the municipalities through two legislative authorities: Clean-up statute and a municipal exemption for preexisting contamination.

The Non-profit Role in Acquisition

Land trusts and their role in acquiring land are defined. Benefits of using land trusts are highlighted including prinking private funds into a project. Two case studies – the La Crosse Blufflands Protection Program and Bayfield’s Brownstone Trail – illustrated the role of public land trusts.
